Q23: When do I need to file in I-134 and when do I need form I-864?
A23: The I-134 is used for K visas even though it is not a requirement. There have been reported cases of a few embassies requesting the I-864 which is not meant to be a requirement until one is adjusting status in the US. What one must remember is that although a K visa is a non-immigrant visa, it is processed in many ways as an immigrant visa. Some embassies use the 100% of the poverty guidelines with the I-134 while others require for 125% of the poverty guidelines . The I-864 is always 125%.
